In Mexico, generic staffing subcontracting is illegal. Your provider needs REPSE.

Mexico's labor reform of April 2021 banned the outsourcing of generic personnel. Since then, only providers listed in the REPSE registry held by the Ministry of Labor may legally supply specialized staff.

The exposure does not sit with the provider. It sits with you. Contracting an unregistered supplier means the service invoices stop being deductible, your company becomes jointly liable for the provider's unpaid labor and social security obligations, and fines run from 173,000 to 4.3 million pesos per irregular worker.

Should you use a global EOR platform or a Mexican provider?

Global employer-of-record platforms do not employ anyone in Mexico themselves. They contract a local Mexican provider that holds the REPSE registration, add a software layer and a margin, and pass the work down. If your need is payroll for people you have already hired, that works. If your need is finding fifty operators in Guadalajara and having them on the floor next week, the platform will hand it to a partner you never chose and cannot call. What foreign companies ask us first.

Can we hire in Mexico without setting up a Mexican entity?
Yes. Contracting a provider with an active REPSE registration lets you run an operation in Mexico without incorporating. The provider is the legal employer, carries the social security and housing fund obligations, and invoices you for a specialized service. Companies typically use this to run a pilot line, staff a first shift, or test a market before committing to incorporation.
What happens if our provider does not have REPSE?
The consequences land on the client company, not only on the provider. Service invoices stop being deductible for income tax and value added tax, your company becomes jointly liable for the provider's unpaid labor and social security obligations, and fines range from 173,000 to 4.3 million pesos per worker in an irregular situation. This is worth verifying before signing, not after an audit.
How is this different from Deel, Rippling or a similar platform?
Those platforms do not hold a Mexican REPSE registration themselves. They contract a local provider, add a software layer and a margin, and pass the work down. That is a reasonable option for payrolling a handful of people you already found. It does not cover recruiting, and it does not cover field or plant crews. We hold our own registration and run our own recruiting operation, so you are contracting the local partner directly instead of through a layer.
How quickly can you staff a position?
Operational roles and field crews deploy in under 72 hours from kickoff. Specialized and management searches, including technology roles and executive search, take 10 to 15 business days to an evaluated shortlist, depending on seniority and location.
Do you work in English?
Yes, with your team. Account communication, reporting and contracts are handled in English. Recruiting and day to day supervision of the staff happen in Spanish, in the local market, which is the only way it actually works.
How do you charge?
A monthly fee per specialized service for recurring staff and payroll, or a fee per closed placement for recruitment and executive search. Invoices are issued under the REPSE framework with the supporting tax and social security documentation for the period, which is what makes them deductible for your Mexican entity if you have one.
