What are staffing solutions in Mexico?

In Mexico, staffing solutions means contracting a provider listed in REPSE, the specialized services registry held by the Ministry of Labor, to recruit and legally employ the people who work on your operation. The provider is the legal employer: it runs the payroll, pays social security and housing fund contributions, and issues a specialized services invoice instead of a payroll you have to defend. Since the labor reform of April 2021, this is the only lawful route for external personnel in Mexico. Generic personnel subcontracting was banned outright, and the compliance exposure for using an unregistered provider falls on the client company, not only on the supplier.

Scope and legal framing

You tell us the roles, the headcount and the city. We confirm which model applies and, critically, whether the service you need can be contracted as a specialized service under REPSE for your particular corporate purpose. If it cannot, we say so at this stage rather than after you have signed.

Salary band and feasibility

We come back with the real local salary range, turnover expectations for that profile in that city, and a realistic time to fill. Foreign buyers are often quoted national averages that do not exist in the specific labor market they are hiring in.

Proposal and fee

A written fee, the applicable legal framework, and the deployment plan with dates. A consultant responds within two business hours during the scoping stage.

Every month, an account receives the stamped invoice for the period, the positive tax compliance opinion, and proof that social security and housing fund contributions were actually paid for the staff assigned to you. Every quarter, the SISUB and ICSOEX filings go out and the acknowledgements are shared.

This is not a courtesy. Without that package, the service invoices are not deductible for income tax or value added tax, and your company can be held jointly liable for obligations the provider failed to pay. A provider who cannot produce these documents on request is telling you something.

Questions about staffing in Mexico.

Do we need a Mexican entity to use a staffing provider?
No. A foreign company can contract a REPSE-registered provider without incorporating in Mexico. The provider employs the staff and invoices the service. If you do have a Mexican entity, the same structure applies with the added benefit that the invoices are deductible for income tax and value added tax, provided the quarterly filings are delivered.
Which roles can be staffed this way, and which cannot?
Plant and warehouse operators, quality and maintenance technicians, supervisors, field crews, administrative and back office staff, engineers, technology profiles and management roles are all standard. The constraint is legal rather than functional: the contracted service must be specialized and distinct from the client's own corporate purpose. We check this during scoping, because getting it wrong is what triggers problems in an audit.
Who directs the staff day to day?
You direct the work. We carry the employment relationship, the payroll, the social security obligations and the supervision of labor compliance. The local consultant assigned to your account handles attendance issues, replacements and escalations, so your managers are not administering Mexican labor matters from another country.
What happens if someone does not work out?
Replacement is handled by us, including the termination process and its legal requirements, which in Mexico are considerably more demanding than in the United States or Canada. For direct hire placements, a replacement guarantee period is defined in the proposal.
How does pricing work?
Recurring staff is a monthly fee per specialized service, quoted on the profile, headcount and location. Direct hire is a fee per closed placement. Payroll processing is priced per cycle and headcount. We quote after scoping, because a quote given before knowing the city and the profile is a number, not a proposal.
Can you support more than one site?
Yes. We operate from our head office in Guadalajara and deploy crews nationally, including Mexico City, Toluca, Veracruz, Monterrey, Querétaro, León, Cancún, Mérida, Tijuana and Puebla. Multi-site accounts get one dedicated senior consultant as a single point of contact and consolidated reporting.
